Question about A Certain Business Contract

Business ContractFriday, December 4th 2009, RiMarket.Net asked Ash-Sheikh Badr Al-Utaybee the following question:

As Salaamu Alaikum wa rahmatullahi wa barakatu Oh Noble Sheik Badr, one of the brothers asks: “Is it permissible for us to work for a company that makes it a condition upon us to sell a certain amount of their product in a year, and if we don’t reach that amount we have to pay a fee of $2000.00?

So Ash-Sheikh Badr Al-Utaybee responded by saying:

Wa alaikum as salaam wa rahmatullahi wa barakatu, to proceed:

From the things that make a contract null and void is “Al-Gararu,” deception, and “Al-Jahaala,” —i.e. when the thing being sold is not present (Such as selling the unborn donkey)—And in this type of contract there includes deception and jahaala, because there is no guaranteed amount you will see of the product in the year. Rather the product may not sell at all, or the consumers may not buy the amount you need them to buy. So therefore this is not permissible.

However,  they can correct the contract, by agreeing to pay you less, and they (the company) then can say ‘If you sell more than such and such amount of the product, then we will pay you a bonus of $2000.00, this is better and more correct, and there is no problem in this.

Important Question about Holidays

Tavaf“….Allah has replaced these days for you with that which is better…..”

The Brothers at RiMarket.Net posed the following question to Our Brother in Al-Islaam and Sheikh Badr Al-Utaybee:

As Salaamu Alaikum wa rahmatullahi wa barakatu wa Ahsan Allahu Ilaykum:
We are writing to you from America with a very important question and we desire that you, oh Noble Sheikh, elaborate in your response. The question: One of the Muslims, who is responsible for the affairs of the students at one of the Universities here in America, encourages the students to celebrate Halloween, which is a holiday of the disbelievers.

This holiday is distinguished by the fact its origin includes magic, devil worshipping, as well as men and women resembling one another, May Allah help us. So this individual said to the students, as he encouraged them to celebrate this holiday: “The Fundamental ruling pertaining to things is that they are permissible, and the Book of Allah nor the Sunnah mention this Holiday specifically, so therefore it is permissible to celebrate it, not as a means of worship, but merely as a custom or tradition.”
So what is the Legislative Ruling pertaining to this individual, and what is your advice to him, keeping in mind he will read your response?

Ash-Sheikh Badr Al-Utaybee responded with the following:

بسم الله الرحمن الرحيم

الحمد لله رب العالمين، وصلى الله وسلم على نبينا محمد، وعلى آله وصحبه أجمعين، أما بعد:

Know, May Allah make you successful, that there is nothing that exists which is outside of Allah’s legislation. Even the things which are merely permissible, they are only permissible because Allah has made them permissible. For this reason, the Scholars of Al-Islaam have included “Mubaah” (permissible/allowable) as one of the five legislative rulings: Obligatory, Recommended, Permissible, disliked, and impermissible. So nothing is allowable or permissible except after the legislation has made it permissible. The celebration of holidays, even if they be from the customs and common practices of the people, is restricted by the Islamic Legislation, because Allah did not leave the celebration of Holidays to be from the permissible affairs, but rather the legislation prohibits taking any day as an annual holiday except the two annual Eids: Eid Al-Adhaa and Eid Al-Fitr and the weekly Jum’aah.

Legislatively, it is not permissible to take any other day as a holiday based on the following evidence, and the impermissibility becomes more intense if these holidays are from the celebrations of the disbelievers and evil sinners. In such a situation there are two affairs that prevent taking these days as holidays:
• This Holiday is a newly invented celebration.
• It is giving life to and honoring the religion of the people of misguidance, and affirming the falsehood which they are upon.

It is reported by Abu Dawood in As-Sunan, as well as Ahmad, An-Nasaaii, and others on the authority of Anas bin Malik, May Allah be pleased with him, he said:

قدم رسول الله صلى الله عليه وسلم المدينة ولهم يومان يلعبون فيهما فقال ما هذان اليومان قالوا كنا نلعب فيهما في الجاهلية فقال رسول الله صلى الله عليه وسلم إن الله قد أبدلكم بهما خيرا منهما يوم الأضحى ويوم الفطر

The Messenger of Allah came to Al-Medina and the people had two days that they used to take as days to play. So he said: “What are these two days?” They said: We used to play during these days before Al-Islaam, in the time of Al-Jahiliyah. So the Messenger said: “Indeed Allah has replaced these days for you, with that which is better: The Day of Al-Adhaa and theDay of Al-Fitr”

So reflect over the fact that the Messenger prohibited them from celebrating these days, in which they were not doing anything except playing. So what about a holiday that includes disbelief, disobedience, and intermingling between men and women, and much evil is spread?
Certainly this is much more dangerous and harmful, and more clearly impermissible.

Based on this, it is incumbent upon this individual who is responsible for the Muslim students to not approve of this behavior and to not celebrate this holiday, and to not bare the sin of these students and not to encourage them to engage in sin, and resembling the disbelievers. And I hope that he does not share the beliefs of the disbelievers, and that he does not support the non-Muslims in what they do and believe during this holiday, even though he made a fatal mistake when he thought that the fundamental ruling pertaining to holidays is that they are permissible. And he made another mistake, when he applied this principle to a holiday known as a holiday of the disbelievers, evil-doers, and devil worshippers.

So it is desired that the individual mentioned, fears Allah, the Most High, and that he becomes responsible, and cultivates the youth upon obedience to Allah, holding firm to Al-Islaam.
Allah’s knows best, May Allah send Peace and Blessings upon His Messenger.

نداء من ربيع السنة للشباب السلفي في كل مكان

Ash-Sheikh Dr. Rabee’ bin Hadee Al-Madkhalee, lion of the Sunnah, said as he addressed the Muslim youth, who are upon the understanding of the pious predecessors:

“Oh Muslim Youth, prepare yourselves to be inheritors of the Prophets, and the Prophets, Peace be upon them, didn’t leave anything as inheritance except knowledge, so whoever grabs hold of it, has attained a large fortune. And this knowledge, its greatest aim is to call to Allah, the Most High, and to rectify the creed of mankind, which will lead to the rectification of their worldly life. There has not be a prophet, except that they faced endless corruption from their communities, and from this corruption is the corruption in Aqeedah.  So what did these Prophets, Peace be upon them,  begin their call with? They did not begin with economic, political, or communal rectification, as they call it. Rather, they began with purifying the belief. If the people’s creed is rectified, than everything will immediately follow, from economic, political, and societal issues. And say what you will, if the people’s aqeedah is not purified, then the people will not be rectified, wherever they may be, because they don’t have a foundation, and if the foundation is missing, then everything else branching from that will be wasted. As for the foundation, it is Al-Aqeedah, the correct belief. All of these actions, are connected with Al-Aqeedah, and follow it. So if the basic belief system is missing, how will we be able to rectify any other realm? This is a reality that anyone of intellect, who seeks rectification, happiness, and good for the ummah, has to be aware of. This is the correct methodology in rectifying the society and anything else. There is no doubt that many factors have come across the ummah which have corrupted many people’s outlooks, beliefs, and methodologies, and are in need of taking lessons from the likes of Ibn Taymiyyah, not from so and so, in order to rectify the ummah and return the muslims to what the Noble Messenger, sallahu alahi wa salaam, and his Companions were upon, may Allah be pleased with all of them, in affairs of belief, methodology, and mannerisms. And all of this will follow if the belief and methodology is correct.”

Benefits from the book “Tawheed Al-I’baadah”

In explaining the statement of Sheikh Al-Islaam Muhammad bin Abdul Wahab: ‘And know, May Allah have mercy on you, that the tawheed which Allah obligated before the obligation of the daily prayer and the obligatory fast: it is that you single out Allah with your worship.”

Ash-Sheikh Dr.Muhammad Bazmool comments by saying:

(…To single out Allah in all acts of worship, it has been made obligatory before the obligation of other legislative matters. For indeed the first affair that the Prophet, sallahu alahi wa salaam, called the people to was “To declare that there is no diety worthy of being worshipped in truth except Allah, and that Muhammad is the slave and messenger of Allah.”

So the First Obligation Upon the Servant: To recognize that Allah alone is to be intended by worship, and not other than him. It has been narrated on the authority of Ibn Umar that the Prophet, sallahu alahi wa salaam, said:

“I have been commanded to fight the people until they declare that there is no diety worthy of being worshipped except Allah and that Muhammad is the Messenger of Allah, to establish the prayer, give the charity; and if they carry out this, there blood and wealth is protected, except with the right of Al-Islaam, and their reckoning is with Allah.” Collected by Al-Bukhari in the Book of Al-Imaan

And the Prophet, sallahu alahi wa salaam, said to his Uncle, Abi Talib:

“Oh Uncle; declare that there is no deity worthy of being worshipped except Allah, by which I can bear testimony in front of Allah of your Imaan, on the day of judgement, and Abu Jahl said to him, “Will you leave that which your forefathers were upon; so he died upon shirk.”

And the statement of Allah was revealed: “Indeed you don’t guide whom you love, but Allah guides whom he wills; and he knows best those who are the guided.” Sura Al-Qasas:56)
